Abstract:
The traditional antitrust legal governance framework exhibits a “failure of deterrence” when addressing the complex new forms of monopoly in digital platforms. To address this, it is necessary to introduce anti-monopoly compliance standards as a new technological governance tool. This approach aims to enhance the self-regulatory capacity of digital platforms in adhering to antitrust laws, thereby achieving several regulatory functions: supplementing the responsiveness defi cit of antitrust law, promoting the intrinsic normative development of digital platforms, and empowering intelligent antitrust regulation. To foster synergistic governance between anti-monopoly compliance standards and antitrust law for digital platforms, three key measures are proposed: fi rst, establishing a comprehensive system of anti-monopoly compliance standards for digital platforms; second, improving the application and supervision of these standards within the framework of antitrust law;and third, ensuring that their implementation remains within reasonable limits.
