Abstract:
Information network technology is constantly innovating, and the use of network technology and the implementation of copyright infringement in the network information environment is becoming more and more common. Among them, deep linking behavior is one form. Over the years, research on the nature, types, and regulatory methods of deep linking behavior has become increasingly common, and the call for its criminalization has also grown stronger. This article summarizes the basic connotation of deep linking behavior by analyzing its characteristics and legal attributes; at the same time, supplemented by empirical investigation, the current criminal justice evaluation of deep linking behavior in China has been summarized. On the basis of practice and theory, through in-depth analysis of the necessity and feasibility of criminalizing deep linking behavior, legislative principles and judicial paths for criminalizing deep linking behavior are proposed to regulate this behavior, protect the healthy development of intellectual property rights, and clarify the cyberspace environment.
